Expert Terms & Conditions

These Expert Terms & Conditions ("Terms") govern your use of AMI Experts ("the Platform", "we", "us") to publish a profile, build pages, display contact details, and receive enquiries. The Platform is operated for and in association with Australian Marketing Institute. By accepting these Terms — and each time you publish or save published content — you agree to be bound by them. If you do not agree, do not publish content and do not use the Platform.

1. Eligibility and membership

Access to publish on the Platform is tied to your current, paid membership and your standing with Australian Marketing Institute. You must keep your membership in good standing to keep your profile and pages live.

You must provide accurate information about yourself, your qualifications, and your professional credentials, and keep it up to date. You must not impersonate any person or misrepresent your affiliation with any person or organisation.

2. Your content and your responsibility

“Your Content” means everything you submit, upload, publish or display through the Platform — including your bio, headline, specialties, credentials, images, videos, links, pages, content blocks, services, pricing, testimonials, and any contact details.

You are solely and fully responsible for Your Content, including its accuracy, completeness, legality, and the consequences of publishing it. We do not pre-vet Your Content and are not responsible for it. You warrant that Your Content is true and not misleading, that you have all rights necessary to publish it, and that it does not infringe the rights of any third party.

Any testimonials, results, statistics or case studies you publish must be genuine, substantiated, and not misleading or deceptive. You must hold evidence to support any claim you make.

3. Prohibited content and conduct

You must not publish, link to, or use the Platform to distribute any content or engage in any conduct that:

• is unlawful, or breaches any law, regulation, or industry code (including the Australian Consumer Law and the Competition and Consumer Act 2010 (Cth));

• is false, misleading or deceptive, or likely to mislead or deceive;

• is defamatory, harassing, threatening, or that incites, promotes or condones violence, hatred, discrimination, or other unlawful sentiment against any person or group;

• is obscene, hateful, or otherwise objectionable;

• infringes any intellectual property, privacy, confidentiality, moral or other right of any person;

• contains malware, or is used to send spam, phishing, or unsolicited commercial messages;

• impersonates any person or misrepresents an affiliation, endorsement or accreditation.

You must not use the Platform to harvest data, interfere with its operation or security, or use it other than for your own genuine professional profile.

4. Contact details, enquiries and privacy

Displaying contact details (such as your email address or phone number) and collecting enquiries through a contact form is optional and entirely your choice. If you choose to do so, you are the party responsible for those details and for any personal information you collect, receive, store or use.

You must comply with all applicable privacy and anti-spam laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and the Spam Act 2003 (Cth). You must only contact enquirers for the purpose for which they contacted you, handle their information securely, and honour requests to access, correct or stop contact.

We pass enquiries submitted through your pages to the contact address on your account so that you can respond. We are a conduit only; we are not responsible for how you handle enquiries or the personal information in them, and you indemnify us and Australian Marketing Institute in respect of that handling.

5. Licence to display Your Content

You retain ownership of Your Content. You grant AMI Experts a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for formatting and display), publish and display Your Content for the purpose of operating, promoting and providing the Platform, including in the public directory and in embeds on third-party sites.

This licence continues for so long as Your Content is published and for a reasonable period afterwards to allow for removal from caches and backups.

6. AMI name and marks

Australian Marketing Institute and its names, logos, designations and marks (including membership and certification designations) are owned by AMI. You must not use them except as expressly permitted, and any reference you make to AMI membership, certification or designation must be current and accurate.

Your participation in the Platform does not make you an employee, agent, partner or representative of the Platform or of AMI, and you must not represent otherwise.

7. Accountability and indemnity

You accept full accountability for Your Content and your conduct on the Platform.

To the maximum extent permitted by law, you indemnify and will keep indemnified AMI Experts, its operators, officers, employees and contractors, and Australian Marketing Institute, against all claims, demands, proceedings, liabilities, losses, damages, costs and expenses (including reasonable legal costs) arising out of or in connection with: (a) Your Content; (b) your use of the Platform; (c) your breach of these Terms; or (d) your breach of any law or third-party right.

8. Suspension and termination

We may remove or disable any of Your Content, and suspend or terminate your access and membership, at our discretion — including immediately and without notice for a serious or repeated breach of these Terms, or where we reasonably believe Your Content or conduct exposes us, AMI, or any third party to risk or liability.

Termination for breach does not entitle you to any refund of fees. On termination, your profile and pages will be unpublished or removed.

9. Disclaimer and limitation of liability

The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all warranties not expressly set out in these Terms and are not liable for any indirect, incidental or consequential loss, or any loss of profit, revenue, data, goodwill or opportunity.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Where our liability can be limited, it is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

10. Changes to these Terms

We may update these Terms from time to time. When we make a material change we will publish the updated Terms and increment the version, and you will be asked to accept the new version before you can continue to publish or save published content. Each time you publish or save published content you reaffirm your acceptance of the then-current Terms.

11. Governing law

These Terms are governed by the laws of NSW, and you submit to the non-exclusive jurisdiction of the courts of that place.
